We strongly recommend that you read all the details on the website relating to your tour before booking to ensure that you understand the itinerary and the tour you will be taking. By making a booking, the person whose name appears first on the booking accepts, on behalf of all persons named on the booking, that:

- You have read these Booking Conditions and our guidelines and are authorised and agree to be bound by them.
- You consent to our use of your personal data in accordance with our Privacy Policy and you are authorised, on behalf of all persons named in the booking, to disclose your personal data to us, including, where applicable, special categories of data (such as information about health conditions or disabilities and dietary requirements).
- He/she is over 18 years of age and, in case of requesting age-restricted services, declares that he/she and all members of the group are of appropriate age to purchase such services and accepts financial responsibility for payment of the booking on behalf of all persons listed on the booking.
1. 1. Booking and payment of the tour
The booking is effective upon payment of 25% of the total cost of the chosen tour (or full payment if booked within 60 days prior to departure). You must provide all requested details including your full name, date of birth, nationality, ID or passport number, date of issue and expiry and any pre-existing medical condition that may affect your ability to undertake the tour (see clause 17) before we can confirm your booking.
We reserve the right to refund the deposit and to refuse to issue a booking confirmation at our absolute discretion. Please note that some tours will only take place if a minimum number of participants is reached.
A binding contract will be formed between you and us on receipt of the booking confirmation. An equipment list, tour notes and meeting point travel information will also be sent to you upon receipt of your deposit/full payment.
On receipt of your booking, you should check that all details are correct. If there are any errors, you must notify us immediately within seven days of our dispatch. Once you have made your booking, you will receive instructions for meetings and tour arrangements two weeks prior to the tour start date.
Final payment information is included with the booking confirmation. The balance of the tour amount (including any applicable surcharges) must be paid at least 60 days before the scheduled departure date. If we do not receive this balance in full and on time, we reserve the right to treat your booking as cancelled by you, in which case we will retain your deposit and the cancellation charges set out below will be payable.
Any amount paid to one of our authorised agents will be held in trust at all times, but will be subject to the agent’s obligation to pay it to us pending our financial failure. In the event of our financial failure, any money held by the agent at that time or subsequently accepted by the agent from the consumer will continue to be held by the agent in trust, without any obligation to pay it to us.
2. Pre-departure documentation
Once your booking has been confirmed, if requested by us, it is an essential condition that you send us a medical statement and/or a self-assessment form provided by a medical professional (see clause 14), prior to your departure.
Note: If you fail to provide the pre-departure documentation requested by us, we reserve the right to treat your booking as cancelled by you and to impose the cancellation charges set out below (see clause 10).
3. Accuracy
We endeavour to ensure that all information and prices, both on our website and in our advertising material, are accurate. We reserve the right to correct prices and other details. We are not responsible for any errors, omissions or inadvertent misrepresentations that may occur and reserve the right to correct them. The dates, itineraries and prices available on our website and publicity material are indicative only, so please contact us directly at contacto@theosados.com for the current price of the tours you wish to book. Before making your booking, please be sure to check the current price and all other details relating to the tour you wish to book.
Please note that prices quoted on our website are based on twin share accommodation and may be subject to change without notice. You may be charged a supplement for single occupancy, as detailed in the tour information on our website.
4. Flexibility
You should note that the nature of this type of tour requires considerable flexibility and should allow for minor modifications to the arrangements booked. The itinerary provided for each tour is representative of the types of activities contemplated, but it is understood that the route, times, itineraries, services and mode of transport may be subject to alteration without notice due to local circumstances or events. See clause 11 for more information on when this will be the case and the types of changes this may include.
5. Insurance
All participants of The Osados are strongly advised to take out travel insurance at the time of booking. Your travel insurance should cover personal accident, death, medical expenses and emergency repatriation. We also strongly recommend that it covers cancellation (and cancellation fees), curtailment, interruption and personal liability, as well as loss of baggage and personal effects. If you choose to travel without adequate insurance cover, we will not be liable for any loss, whatever its source.
6. Prices
All prices and payments will be processed in Euros (€EUR).
We reserve the right to change the price of unsold tours at any time and to correct errors in confirmed tour prices. We also reserve the right to increase the price of confirmed tours only to allow for increases that are a direct result of changes in:
– The price of passenger transport resulting from the cost of fuel or other energy sources; – Exchange rates relevant to the combined tour.
Such variations may include, but are not limited to, changes in costs that form part of our contracts with transport providers.
You will be charged the amount of any increase in accordance with this clause. However, if this means that you have to pay an increase of more than 8% of the price of your confirmed tour (excluding any insurance premiums, amendment fees and/or additional services or tour arrangements), you will have the option to accept a change to another tour if we are able to offer one (if this is of a lower quality you will be refunded the difference in price), or cancel and receive a full refund of all monies paid to us, except for insurance premiums and amendment fees and/or additional services or tour arrangements. If you decide to cancel for this reason, you must exercise your right to do so within 7 days of the issue date printed on your invoice.
In the event that the price of your tour decreases due to the above changes, any refund due will be credited minus an administration fee of €50.00 per booking per person. However, please note that tours are not always purchased in local currency and that some apparent changes do not impact the price of your tour due to contractual and other protections in place.
No refunds will be paid for your confirmed tour within 20 days prior to departure.
7. Jurisdiction and Applicable Law
These Booking Conditions and any agreement to which they apply shall be governed in all respects by Spanish law. We both agree that any dispute, claim or other matter arising between us or relating to your contract or booking will be dealt with only by the Courts of Spain.
8. Shortening your tour
If you are forced to return home early, we will not be able to refund the cost of any unused tour services. If you shorten your tour and return home early in circumstances where you have no reasonable grounds for complaint about the standard of accommodation and services provided, we will not offer you any refund for the part of your tour not completed, nor will we be liable for any associated costs you may incur. Depending on the circumstances, it is possible that your travel insurance may provide cover in the event of tour interruption, so we suggest that you make any claims directly with them.
9. If you change your booking and transfers of bookings
If you wish to change any part of your booking after our confirmation invoice has been issued, you must notify us by email to contacto@theosados.com as soon as possible. Your notification of change will only take effect when it is received by us in writing and will be effective from the date we receive it. This must be done by the person named first on the booking. While we will do our best to assist you, we cannot guarantee that we will be able to meet your request for a change.In the event that we are able to accommodate your request, all changes will be subject to the payment of an administration fee of €50.00 per person per change and any applicable fare changes or additional costs or charges incurred and/or imposed by any of our suppliers in making this change. You should note that these costs may increase the closer to the departure date you make the changes and you should contact us as soon as possible. In the event that we are unable to assist you and you do not wish to continue with the original booking, we will treat this as a cancellation on your part. In accordance with clause 10, a cancellation fee may be payable. No changes to the booking are permitted within 7 days prior to departure.
Transfer of booking: If you or any member of your party is unable to travel, that person(s) may transfer their place to another person, provided that the following conditions are met:
– That person is introduced by you and meets all conditions applicable to the tour; – We are notified in writing at least 7 days prior to departure; – You pay any outstanding balance, an amendment fee of €50.00 per person transferred, as well as any additional fees, charges or other costs arising from the transfer (including those imposed by any of our suppliers); and the transferee accepts these booking conditions and all other terms of the contract between us.
You and the transferee will remain jointly and severally liable for payment of all amounts. If you are unable to find a replacement, the cancellation charges set out in clause 10 will apply to cover our estimated costs. Otherwise, no refunds will be made for passengers who do not travel or for services not used.
Important Note: Certain arrangements cannot be altered or transferred after they have been confirmed and any alteration may incur cancellation charges of up to 100% of that part of the arrangements.
10. If you cancel your booking before departure.
If you or any other member of your party decides to cancel your confirmed booking, you must notify us by email to contacto@theosados.com as soon as possible. Your notice of cancellation will only take effect when we receive it in writing at our offices and will be effective from the date we receive it.
In the event that one or more members of a group cancel, the price of the tour per person for those who continue to travel may increase and you will be liable to pay any such increase.
As cancellation of your tour incurs costs for us, you will be required to pay the cancellation fees as follows:
More than 60 days: Deposit only. 29 – 60 days: 30% of the tour price. 15 – 28 days: 65% of the tour price. 7 to 14 days: 75% of the tour price. Less than 7 days: 100% of the tour price.
Please note that amendment fees and administrative fees are not refundable in any case.
Important note: Certain services cannot be modified once confirmed, and any modification or cancellation may incur cancellation fees of up to 100% of that part of the service, in addition to the above mentioned fees.
If the reason for cancellation is covered by the conditions of your insurance policy, you may be able to claim these costs.
Where possible, we will deduct the cancellation costs from the amount you have already paid us.
Cancellation by you due to unavoidable and extraordinary circumstances: You have the right to cancel your confirmed tour prior to departure without payment of cancellation fees in the event that ‘unavoidable and extraordinary circumstances’ occur at or in the vicinity of your tour destination and significantly affect the conduct of the tour or significantly affect the transport arrangements to the destination. In such circumstances, we will reimburse you in full, but will not be obliged to pay you any additional compensation. Please note that your right to cancel in these circumstances will only apply where the Spanish Ministry of Foreign Affairs advises against travel to or near your destination. For the purposes of this clause, ‘unavoidable and extraordinary circumstances’ shall mean war, acts of terrorism, significant risks to human health such as the outbreak of a serious disease at the tour destination, or natural disasters such as floods, earthquakes or weather conditions which make it impossible to travel safely to the tour destination.
11. If we change or cancel your tour
As we plan your tour arrangements many months in advance, we may occasionally have to make changes to or cancel your booking and we reserve the right to do so at any time. You should also note that the nature of this type of tour requires considerable flexibility.
Changes: If we make a minor change to your tour, we will make every reasonable effort to inform you or your travel agent as soon as reasonably possible if there is time before departure, but we will have no liability to you. Examples of minor changes are changes of accommodation to the same or higher standard, changes of carriers, cycle routes, services, timetables and mode of transport. Please note that the transport providers used in our publicity material may be subject to change.
After departure: We reserve the right to change an itinerary after departure as a result of weather conditions, local circumstances or events beyond our control or force majeure events (see clause 12). In such emergency circumstances the additional cost of any necessary alterations to the itinerary will be borne by you. In this case, we shall not be liable for any incidental expenses that may be incurred as a result of the change of itinerary, such as visas or vaccines.
Occasionally, we may need to make a significant change to your confirmed tour arrangements. Examples of “significant changes” include the following, provided they are made prior to departure:
– A change of accommodation area for all or a significant part of your stay.- A change of accommodations to a lower quality or classification for all or a significant portion of your stay.- A change of departure time or total tour duration by more than 12 hours.- A significant change in your itinerary, omitting one or more destinations entirely. Cancellation: We will not cancel your tour less than 60 days before the departure date, except for reasons of force majeure or non-payment of the final balance. We may cancel your tour prior to that date if, for example, the minimum number of customers required for a particular tour is not reached.
If we have to make a significant change or cancel, we will let you know as soon as possible and, if there is time to do so before departure, we will offer you the option to:
– (in the case of significant changes) accept the changes; or a refund of all monies paid; or if available and offered to you, accept the offer of an alternative tour (we will refund you the difference in price if the alternative tour is of lesser value).
You must notify us of your choice within 7 days of our offer. If we do not hear from you within 7 days, we will contact you again to ask you to notify us of your choice. If you do not respond again, we will assume that you have decided to accept the change or alternative booking.
Compensation In addition to a full refund of all monies paid by you, we will pay you compensation as detailed below in the following circumstances:
– If, in the event that we make a significant change, you do not accept the changes and cancel your booking; – If we cancel your booking and no alternative is available or offered to you.
The compensation we offer you does not prevent you from claiming more if you are entitled to it.
Notice period before departure:
More than 60 days: £0.00 29 – 60 days: £25.00 15 – 28 days: £35.00 7 – 14 days: £40.00 Less than 7 days: £50.00
*PLEASE NOTE: We will not pay you compensation in the following circumstances:
– When we make a minor change; – When we make a major change or cancel your tour more than 60 days before departure.- When we make a major change and you accept the modified arrangements or accept an offer of alternative tour arrangements.- If we are forced to cancel the tour because you have not made full payment on time.- When the modification or cancellation by us is due to changes to the confirmed booking requested by you.- When we are forced to cancel or modify your tour due to force majeure (see clause 12).
We regret that we are unable to meet any expenses or losses you may incur as a result of a change or cancellation, including any incidental expenses you may have incurred as a result of your booking, including but not limited to visas, vaccinations, travel insurance excesses or non-refundable air, train or coach tickets.
Please note that if we offer you accommodation at a higher price than the original price and you accept it, the difference in price will be deducted from the compensation.
In no event will we pay compensation if we offer you accommodation and you accept it at a higher price than originally booked at the same location and you do not make any additional payment.
In the event that we are unable to provide a significant part of the services you have booked with us after your departure, we will, if possible, offer you alternative services at no additional charge and, if such alternative services are of a lower standard, we will offer you an appropriate reduction in price.
Force Majeure
Unless otherwise expressly stated in these Booking Conditions, we shall not be liable or pay any compensation to you if our contractual obligations to you are affected by “Force Majeure”. For the purposes of these Booking Conditions, Force Majeure shall mean any event beyond our or our supplier’s control, the consequences of which could not have been avoided even if all reasonable measures had been taken. Examples include acts of God, war (declared or undeclared) and acts of terrorism (and threat thereof), insurrection, explosion, civil strife, epidemic, plague, pandemic (including but not limited to the current effects of Covid-19 and any future strain of coronavirus), significant risks to human health such as the outbreak of a serious disease at the tour destination or natural disasters such as floods, earthquakes, the action of any government or other national or local authority, including port or river authorities, labor disputes, strikes, lockout, quarantine, government intervention, natural or nuclear disaster, fire, chemical or biological disaster, unavoidable technical problems with transportation and all similar events beyond our control or that of the supplier(s) concerned.
If The Osados and/or any of its suppliers are affected by Force Majeure, it shall be entitled to, and may at its sole discretion, vary or cancel any itinerary or agreement in relation to the tour. In respect of civil unrest, once The Osados has investigated the prevailing situation, as it sees fit, it shall be at the sole and absolute discretion of The Osados whether or not to proceed with the tour.
Brexit implications: please note that certain tour arrangements may be affected as a result of the United Kingdom’s decision to leave the European Union. This could include the unavailability of certain air routes, access to certain ports and airports, and changes to visa requirements for British citizens traveling to, within, or through the EU. Please be assured that we will continue to monitor this situation and will advise our customers as soon as possible if we become aware of any confirmed bookings that are affected. However, as this is unprecedented and beyond our control, we will treat any such change as force majeure and, while we will endeavor to offer suitable alternatives or refunds where possible, we will not be obliged to pay you any compensation.
13. Acceptance of risks and responsibilities as a tour participant
You acknowledge that the nature of a mountain or gravel
bike tour is adventurous and that participation involves a degree of personal risk. It is your own responsibility to inform yourself of all possible pertinent information about the tour and the nature of the itinerary, and you acknowledge that your decision to travel is made with such information in mind and that you assume the personal risks inherent in such a tour.
You also acknowledge and clearly understand that during the course of the tour certain risks and dangers may occur, including but not limited to the dangers of traveling in mountainous regions and that by the very nature of the activities you are exposed to an element of personal risk over and above those associated with conventional tours. You agree to assume all risks associated with the tour and agree that The Osados shall not be liable in the event of participant delay, or for any loss or damage to participant’s property, including your bicycle or other cycling equipment, during the course of the tour.
In addition, you must be physically fit and have an adequate level of competence to undertake the itinerary set out in the tour you have chosen. You therefore accept and consent to the risks inherent in the application of these Booking Conditions and accept as reasonable the limitations of our liability.

Further information will also be provided to you in your tour briefing.Nothing in this clause or in any part of these Booking Conditions is intended to exclude or limit The Osados’ liability for death or personal injury caused by our negligence.
Minimum
Age
: General Policy: For most of our tours the minimum age is 18 years in the interest of health and safety. In exceptional circumstances we may allow children between 12 and 18 years of age to participate in a tour, however, they must be accompanied by a responsible adult to join one of our tours. The final decision of participation will be at the discretion of The Osados.
Maximum: General Policy: For most of our tours we have no age limit, although we remind you that our tours can be physically demanding, as stated in clause 13. Therefore, a medical statement and/or a self-assessment
form provided by a medical professional may be required for clients with less mobility and where you have notified us of any medical, health or mobility issues. This is in the interest of health and safety. Please contact us to discuss the challenges of your chosen tour and any concerns you may have by emailing
contacto@theosados.com. 15. Tour Authority
Our group tours are led by a guide from The Osados. The guide’s decision is final on all matters that may affect the safety or well-being of any person participating in the tour. If you do not comply with a decision made by a guide, or interfere with the welfare of the group, the guide may order you to leave the tour immediately, without refund. In such a circumstance, if a participant is expelled from the tour, The Osados will not be responsible for his or her transportation back to the tour end point or any costs incurred as a result. Any transportation arranged for the participant in question will be at the sole discretion of The Osados.
We may also choose not to transport you on future booked tours. You must at all times comply with all drug laws and regulations.
16. Special Requests
Any special requests must be communicated to us at the time of booking, e.g. diet, room location, a particular hotel facility, etc. You must then confirm your requests in writing. While we will do our best to accommodate your reasonable special requests, we cannot guarantee that they will be honored. The fact that a special request has been noted on the confirmation invoice or any other document, or has been transmitted to the supplier, does not confirm that it will be honored. Failure to comply with any special request will not constitute a breach of contract by us unless the request has been specifically confirmed by us. We do not accept reservations conditioned on the fulfillment of any special request.
17. Disabilities and medical conditions
We are not a company specializing in tours for the disabled, but we will do our best to accommodate any special needs you may have. If you or any member of your party has a medical condition or disability that may affect your booking, please provide us with full details prior to booking so that we can advise you on the suitability of the services chosen. We may ask you to provide a medical certificate stating that you are fit to participate. Acting reasonably, if we cannot adequately accommodate the needs of the person(s) concerned, we will not confirm your booking or, if you did not provide us with full details at the time of booking, we will cancel your booking and impose the applicable cancellation charges when we become aware of such details.
We recommend that you are in adequate physical condition to cover the distances and carry out the program set out in your itinerary. If it is deemed that any client is not sufficiently fit, healthy, adequately equipped or able to complete the tour without affecting your safety, comfort or happy progress, the tour leader has at any time the sole discretion and right to withdraw you from the tour.
Complaints
We make every effort to ensure that your tour arrangements run smoothly, but if you have any problems during your tour, please inform the relevant supplier (e.g. your hotelier) and/or The Osados or your guide immediately, who will endeavor to resolve the problem. If your complaint is not resolved locally, please contact contacto@theosados.com. Failure to do so while on tour will extinguish or reduce your ability to claim compensation from The Osados.
If the problem cannot be resolved and you wish to pursue your claim, you must send formal written notification to our offices, ideally within 14 days of the end of your stay, stating your booking reference and all relevant information. Please keep your letter concise and to the point. This will help us to quickly identify your concerns and speed up our response. Failure to comply with the procedure set out in this clause may affect our ability and that of the applicable supplier to investigate your complaint, and will affect your rights under this contract.
19. Tour start date
It is your responsibility to be prepared to embark on the tour as specified in the itinerary. The Osados is not responsible for any loss due to cancelled or missed flights, changes in flight itineraries, late arrivals or early departures. Our responsibilities do not begin until the appointed time at the designated meeting point.
20. Flight Delays
If you or any member of your party misses your flight or other means of transportation, is cancelled or is delayed for more than 3 hours for any reason, you must contact the airline or other transportation provider directly and immediately. Since we do not offer flights or other means of transportation as part of our combined tour, we have no liability to you in connection with such delays or cancellations. However, any airline or other transportation provider may pay for or provide refreshments and/or suitable accommodation and you should make a claim directly to them.
21. Your behavior
All our customers are expected to behave in an orderly and acceptable manner and not to disturb the enjoyment of others in any way. If in our opinion or in the opinion of any hotel manager, guide of The Osados or any other person in authority, your behavior or that of any member of your party causes or is likely to cause distress, hardship, danger, risk, disruption or annoyance to other customers or third parties, or damage to property, or cause a delay, disruption or diversion of transport or an excursion, we reserve the right to immediately terminate your booking with us. In the event of such termination, our liability to you and/or your party will cease, and you and/or your party must immediately vacate your accommodation or other services. We shall have no further obligation to you and/or your party. No refunds will be made for loss of accommodation or otherwise and we will not pay any expenses or costs incurred as a result of termination. You and/or your escort may be required to pay for loss and/or damage caused by your actions and we will hold you and each member of your escort jointly and severally liable for any damage or loss caused by you or any member of your escort. Payment in full for such damage or loss must be made directly to the hotel manager or other supplier prior to departure. If you fail to make payment, you will be liable for any claims (including legal costs) subsequently made against us as a result of your actions and for all expenses incurred by us in pursuing any claim against you.
We are not responsible for the actions or behavior of other guests or persons who have no connection with your reservation or with us.
22. Your Equipment
Bicycle Rental.You have the option of renting bicycles from The Osados or third parties for use during the tour. The cost of bicycle rental is an additional charge to the cost of the tour and, therefore, is not part of the combined tour price. Your rental contract will be with The Osados or the third party.
In either case, it is your responsibility to ensure that you have a suitable bicycle with you to participate in the tour, whether it is your own bicycle or one you have rented from a third party company. You agree that you are responsible for the condition and maintenance of the bicycle and any other equipment you use during the tour. It is also your responsibility to have sufficient insurance for the bicycle you use during the tour.
Please note that while we will make every reasonable effort to ensure the safety of your bicycle, we are not responsible for any loss or damage to your bicycle as a result of your participation in the tour or otherwise
23. Excursions
Excursions or other tours that you choose to book or pay for during your tour do not form part of the combined tours you have contracted with us. For any excursion or tour you book, your contract will be with the excursion or tour operator and not with us. We are not responsible for the performance of the excursion or tour or for anything that occurs during the performance of the excursion or tour by the operator.
Many of the services that make up your tour are provided by independent suppliers. These suppliers provide these services in accordance with their own terms and conditions, which will form part of your contract with us. Some of these terms and conditions may limit or exclude the supplier’s liability to you, usually in accordance with applicable International Conventions. You may request copies of the relevant parts of these terms and conditions from us or from the supplier concerned.
25. Immediate Assistance
If, while on tour, you get into difficulty for any reason, we will offer you such immediate assistance as is appropriate in the circumstances. In particular, we will provide you with appropriate information on health services, local authorities and consular assistance, as well as assistance with remote communications and finding tour alternatives. If you require assistance that is not due to a fault on our part, or that of our employees or subcontractors, we will not be liable for the costs of alternative tour arrangements or any other assistance you require.
26. Delays, loss of transportation and other tour information
The Osados does not sell flights. If you or any member of your party misses your flight or any other means of transport, is cancelled or is delayed for more than 3 hours for any reason, you must contact us and the airline or other relevant transport provider immediately.
Under EU law, where applicable to you, you may be entitled to reimbursement or compensation from the airline in the event of denied boarding, cancellation or delay of your flight. Full information on these rights will be published at EU airports and will also be available from airlines.
27. Release of images
During your tour, it is possible that The Osados and other tour participants may take photographs and/or videos. This will be discussed at the tour briefing and you will be given the opportunity to object and/or consent to the taking of such photos/videos.
The Osados may use, reuse and reproduce any images, photos or videos that you consent to and submit to us, or that are taken by our guides and/or other participants of you individually or as a group, in any media, including but not limited to print, electronic media or the internet, free of charge and without your right of inspection, to promote and advertise our products and services worldwide. If you do not want us to use images of you taken by us or by other participants during the tour, you must inform us or the tour leader at the beginning of the tour.
